Driver Charged with Triple Homicide After Fatal Crash in Inhapim

The Public Prosecutor's Office of Minas Gerais (MPMG) has formally charged a 36-year-old man in connection with the deaths of a father and his two children in a severe traffic accident. The incident occurred on February 14th of this year, at kilometer 491.9 of the BR-116 highway in Inhapim, located in the Vale do Rio Doce region. The accused driver is also facing a charge of attempted homicide for the mother of the children, who survived the crash.

According to the MPMG, the accident was caused by the accused driver's repeated dangerous overtaking maneuvers. While attempting to pass another vehicle on a continuous lane, a prohibited action, he entered the opposing lane and struck the family's car on its side. The impact caused the family's vehicle to leave the roadway, overturn, and fall into the Caratinga River, where it became partially submerged. The father and his two children tragically lost their lives, while the mother sustained injuries and significant psychological trauma.

Forensic reports, witness testimonies, and other evidence indicate that the illegal overtaking was the primary cause of the fatal collision, with no evidence of braking marks found at the scene. The MPMG argues that the driver knowingly risked causing death by executing such a dangerous maneuver in a clearly prohibited zone. Consequently, he has been charged with three counts of homicide and one count of attempted homicide under the legal concept of 'dolo eventual,' which implies assuming the risk of causing death. The prosecution is seeking a trial by jury, compensation for the victims' damages, and the suspension or revocation of the accused's driver's license.
