Loan Danilo Peña Case: Trial Begins Amidst Allegations of Impunity Pact

The trial for the disappearance of five-year-old Loan Danilo Peña, who vanished on June 13, 2024, near 9 de Julio, Corrientes province, Argentina, has commenced. Approximately 500 individuals, including police, gendarmerie, and the army, conducted extensive searches across 10,000 hectares using drones and dogs, while Alerta Sofía and Interpol were activated. Seven main accused individuals, including María Victoria Caillava, her partner Carlos Guido Pérez, Loan's aunt Laudelina Peña and her partner Antonio Bernardino Benítez, Mónica Carmen Millapi and her husband Daniel Ramírez, and police commissioner Walter Maciel, are central to the case. Maciel is accused of obstructing the investigation and creating a false search scenario. Tracker dogs indicated Loan was likely taken captive near his grandmother's home and a nearby orange grove, with scent marks found in Caillava's vehicle. The case evolved from "abandonment of a person" to "minor abduction" and later "trafficking for exploitation," though a trafficking network hypothesis was dismissed by the judiciary. The current charge is abduction, retention, or concealment of a minor, a non-prescriptive offense, combined with accusations of derailing the investigation, forming a large case with 17 defendants. Most accused of abduction are detained for the trial, which began on June 16 in the Federal Oral Court of Corrientes. However, their pre-trial detention is limited to two years, raising concerns that a pact of silence could impede progress. Ten additional individuals, linked to the Lucio Dupuy Foundation and the "Hotel Gang," face charges including obstruction of justice, false testimony, and drug supply. The prosecutor requested the detention of nine of these individuals, who initially appeared free. The investigation into who ordered children to be taken to a hotel to influence their testimony is ongoing. Twenty-three cell phones were analyzed, though much data was erased. A total of 171 witnesses are expected to testify, with a verdict likely by year-end. Prosecutors acknowledge knowing who took Loan but not the motive, highlighting the legal challenge of proving intent. Defense attorneys are raising procedural nullities and suggesting an accident, a theory contested by the grandmother's testimony.
