New York Halts New Data Center Construction for One Year Amid Environmental Concerns

New York has become the first U.S. state to impose a one-year moratorium on the construction of large new data centers, a move Governor Kathy Hochul announced on Tuesday. This decision stems from growing concerns about the environmental impact of these facilities, which are crucial for the artificial intelligence boom. The moratorium aims to address issues such as increased power costs, strain on water supplies, and the burden on local communities. Governor Hochul also plans to pursue legislation to eliminate sales tax exemptions for these large data centers. The construction ban specifically targets facilities requiring 50 megawatts or more of power. During this period, the state's Department of Environmental Conservation will not issue discretionary permits for new data centers unless they are already deemed complete. Instead, state officials are tasked with developing a Generic Environmental Impact Statement to establish consistent standards for new data centers and to thoroughly examine their potential environmental effects. The moratorium will be lifted once these standards are finalized. This action places New York at the forefront of a national discussion on managing AI infrastructure. While technology companies are rapidly expanding data centers, many states are considering measures to mitigate their impact on electricity grids and local environments. A recent Reuters/Ipsos poll indicated that only one in three Americans approve of the current pace of data center construction, with most opposing such facilities in their own communities. New York's legislature had previously passed a bill with similar, though broader, aims, targeting data centers consuming over 20 megawatts, but it has not yet been signed into law. The state's grid operator reports over 12 gigawatts of high-energy-demand loads, including data centers, are slated for connection, at a time when New York already faces high residential electricity prices.
